This Privacy Notice explains how XLR8 and its affiliates ("XLR8", "Company", "we", "us" or "our") collects, uses, discloses, and otherwise processes your personally-identifiable data ("Personal Data"), and explains your rights and choices regarding your Personal Data.

This Privacy Notice applies when we collect, use, and share Personal Data in connection with our websites and subdomains at https://www.tryxlr8.ai/, or collect data from prospective customers, such as requests to demo our products and services (collectively, the "Services").

This Privacy Policy does not address our privacy practices relating to XLR8 job applicants, employees and other personnel. If you are a job applicant, please ask our team for this information.

Our Services may include links to third-party websites, plug-ins and applications. If you follow a link to any of these third-party offerings, please note that they may have their own privacy policies and that we do not accept any responsibility or liability for those policies. Please check those policies before you submit any data to the third parties.

Personal Data We Collect

Data You Give Us

You may give us Personal Data by signing up for an online account, entering information through our online forms or surveys, inputting information while using our Services, or contacting us for information or customer service.

The categories of Personal Data include:

  • Identifiers and Contact Information, such as first and last name, email address, postal address, Internet Protocol address, phone number, your country or region, and communication preferences.
  • Categories of Personal Data described in Section 1798.80(e) of the California Civil Code, such as name, address, telephone number, employment, and similar information. Your identifiers are associated with your company's account.
  • Professional or Employment-related Information, such as employer, job title, your area of responsibility, and company name.
  • Internet or Other Electronic Network Activity Information, such as Google Analytics records, browsing history, search history, and information regarding a consumer's interaction with an Internet website, application, or advertisement.
  • Geolocation Data, such as approximate geographic location when accessing our Services.
  • Inquiry and Communications Information, such as information provided in custom messages sent through our online forms or to our email address, such as to request a demo or submit a testimonial.
  • Feedback Information, such as feedback and ratings you provide relating to our Services or products.
  • Inferences derived from the above information.

The categories of sensitive Personal Data include:

  • Account Log-in Information, in combination with any required security or access code, password, or credentials allowing access to the account.

Some external service providers may also collect information directly from you (for example, a payment processor may request your billing and financial information) in accordance with their own privacy policy. These external service providers do not share your financial information, like credit card number, with us, but may share limited information with us related to your purchase, like your zip code.

For example, we use third-party payment processor Stripe to process credit card payments made to us. As such, we do not retain any personally identifiable financial information in connection with credit card payments, such as credit card numbers. Rather, all such information is provided directly by you to our third-party processor. The payment processor's use of your Personal Data is governed by their privacy notice.

Usage Data Automatically Collected

As is true of many digital properties, we and our service providers may automatically collect certain information from or in connection with your device or browser when visiting or interacting with our Services. Such data includes:

  • Log Data: Includes internet protocol (IP) address, operating system, device type and version, browser type and version, browser id, the URL entered and the referring page/campaign, date/time of visit, other user agent string data, the time spent on our Services, and any errors that may occur during the visit to our Services.
  • Location Data: Such as general geographic location (not an address) that we or our service providers may derive from your IP address.
  • Other Data: Such as the applications you use or web pages you visit on our Services, or links you click within our emails.

Information We Collect from Your Employer

Your Employer who purchases the Services may share Personal Data with us to help us provision and manage your account.

Information We Collect from Third Parties

To the extent permitted by applicable law, in addition to collection through our websites and Services, we may also obtain Personal Data from third parties.

How We Use Your Personal Data

We may use your Personal Data to:

  • Fulfill or meet the reason the information was provided, such as to fulfill our contractual obligations, to deliver the Services you have requested to you or your Organization and to process transactions, including providing you an online product demonstration;
  • Manage XLR8 and its day-to-day operations;
  • Communicate with individuals, including via email and social media;
  • Request individuals to complete surveys or provide feedback about XLR8, organizations we partner with, and Services;
  • For marketing and updates on products or services we think that you may be interested in (where applicable, we may send you marketing messages if you have given us your consent to do so or where we have relied on the soft opt-in rule);
  • Administer, improve and personalize our Services, including by recognizing an individual and remembering their information when they return to our Services;

  • Facilitate customer benefits and services, including customer support;

Your Employer / Company

If you interact with our Services through your employer or company, we may disclose your information to your employer or company, including another representative of your employer or company.

Affiliates and Service Providers

We share your information with our third-party service providers and any subcontractors as required to offer you our products and services. The service providers we use help us to:

  • Run, operate, and maintain our Services through third-party platforms and software tools;
  • Perform content moderation and crash analytics;
  • Run email messaging campaigns;

With Your Consent or At Your Direction

Children's Personal Data

We have the right to request verification of your identity for all requests for information. In responding to this right, we shall provide you:

  • The categories of sources from which your Personal Data is collected.
  • The business or commercial purpose(s) for collecting, selling, sharing, or disclosing your Personal Data, and the categories of Personal Data disclosed for such purpose(s).

Third Party Marketing

If you are one of our customers, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Data to third parties for the third parties' direct marketing purposes.

Automated Processing & Profiling

Residents of certain U.S. states have the right to opt out of the processing of Personal Data for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects concerning a consumer.

Right to Equal Service & Price

You have the right to receive equal service and price, even if you exercise a privacy right.

Verification Process for Exercising Rights

To protect our consumers' privacy, we verify privacy rights requests to ensure that only you (or your authorized agent) can exercise rights pertaining to your Personal Data. As part of our verification process, we may request you to submit additional information.

If you are an authorized agent wishing to exercise rights on behalf of a state resident, please contact us using the information at the bottom of this Privacy Notice and provide us with a copy of the consumer's written authorization designating you as their agent. Appeal Process
